Ruling 562, Question: Considering that it is permissible for Hajj pilgrims to substitute passing the night (baytūtah) at Minā with spending the night in Makkah al-Mukarramah while in worship, is it valid for them to engage in activities such as eating, doing ghusl (a full-body ritual washing for ṭahārah; major ritual purity), performing ablution (wuḍū’), or relieving themselves during the night?
Answer: Eating and drinking to satisfy basic needs, and leaving for relieving oneself, renewing ablution (wuḍū’), or performing obligatory ghusl are valid.
Ruling 563, Question: In the previous question (in ruling 562), is it obligatory for him to offer kaffārah (expiation; atonement) if a Hajj pilgrim performs an act that is incompatible with engaging in worship?
Answer:If a Hajj pilgrim, instead of passing the night (baytūtah) at Minā, engages in an act other than worship in Makkah al-Mukarramah, and that act is not among necessities (such as eating, drinking, or relieving oneself), it is obligatory for him to offer kaffārah (expiation; atonement).
Ruling 564, Question: Some Hajj pilgrims, due to illness or COVID-19 restrictions, are unable to pass the night at Minā or find it extremely difficult. Is it definitely obligatory for them to perform worship in Makkah al-Mukarramah on the nights of the 11th and 12th of Dhul-Ḥijjah? If they perform worship in Makkah al-Mukarramah, is that sufficient instead of passing the night at Minā, and are they excused from kaffārah (expiation; atonement) for not passing the night at Minā?
Answer: It is not obligatory for the sick to pass the night at Minā, but the obligatory precaution (al-iḥtiyāṭ al-wājib) is that they should offer one sheep as kaffārah (expiation; atonement) for each night. For those unable to pass the night at Minā due to COVID-related restrictions, performing worship in Makkah al-Mukarramah is sufficient, and they are excused from offering kaffārah (expiation; atonement) for not passing the night at Minā.
Ruling 565, Question: When a Hajj pilgrim is excused (ma‘dhūr) from performing the stoning (ramy) of the Jamarāt al-‘Aqabah on the 12th of Dhul-Ḥijjah and is obligated to appoint a proxy (nā’ib), is it permissible for him to leave Minā—after passing the night (baytūtah) at Minā until midnight—and not return there before departing after noon?
Answer: As a matter of obligatory precaution (al-iḥtiyāṭ al-wājib), it is not permissible for them to depart Minā on the night of the 12th of Dhul-Ḥijjah. If they do so, the obligatory precaution (al-iḥtiyāṭ al-wājib) is that they should return to Minā before departing after noon.
Ruling 566, Question: Given the increase in Hajj pilgrims and the limited space in Minā, some tents have been set up on the slopes or at the top of the mountain overlooking Minā. Does passing the night (baytūtah) in these tents at Minā suffice?
Answer: If passing the night at Minā (baytūtah) is not possible, doing so in these tents is valid, and there is no kaffārah (expiation; atonement).
Ruling 567, Question: What is the definition of “night” for the purpose of passing the night (baytūtah) at Minā, and how is midnight determined in relation to the maghrib and ‘Ishā’ prayers?
Answer: The duration of “night” in these two questions is defined as the interval between sunset (ghurūb al-shams) and the break of dawn (ṭulū‘ al-fajr).
Ruling 568, Question: If a Hajj pilgrim departs Minā after noon on the 12th day of Dhul-Ḥijjah and then returns—whether inadvertently, unknowingly, or deliberately—and is present there at sunset on the 13th night, is it obligatory for him to pass that night (baytūtah) and stone (ramy) the Jamarāt al-‘Aqabah on the 13th day?
Answer: If the pilgrim is present in Minā at sunset on the 12th of Dhul-Ḥijjah for any reason, he is obligated to pass the night (baytūtah) at Minā on the 13th and perform the stoning (ramy) of the Jamarāt al-‘Aqabah on that day.
Ruling 569, Question: Is the boundary of Minā defined by the location of the Jamarah al-‘Aqabah or by the ‘Aqabah itself, which is a large mountain pass?
Answer: According to the apparent meaning of the authentic narration (ṣaḥīḥah) of Mu‘āwiyah ibn ‘Ammār, Wādī Muḥassir and the ‘Aqabah are not part of Minā. In other words, Minā is the area between Wādī Muḥassir and the ‘Aqabah. In general, the boundaries of the holy sites (mashā‘ir)—‘Arafāt, al-Mash‘ar al-Ḥarām, and Minā—are not determined with extreme precision, and acting in accordance with what is customarily considered part of the mashā‘ir suffices.
Ruling 570, Question: What is the ruling for a Hajj pilgrim who, during the second baytūtah (passing the night) at Minā, unknowingly exits the boundaries of Minā? If he returns to Minā or does not return, what is the ruling?
Answer: If the exit from Minā lasts only a brief moment—such as two to five minutes—and it is customarily considered that half the night has passed at Minā, then there is no objection. Otherwise, one sheep must be offered as kaffārah (expiation; atonement).
Ruling 571, Question: Is there any ruling—besides being prohibited (ḥarām)—for a Hajj pilgrim who leaves Minā before noon on the 12th of Dhul-Ḥijjah without intending to return to Minā before departing after noon?
Answer: Aside from being prohibited (ḥarām), there is no additional ruling for a Hajj pilgrim who leaves Minā before noon on the 12th of Dhul-Ḥijjah without intending to return to Minā before departing after noon.
