The Istiftā’āt (Juristic Inquiries) on Stoning (Ramy) the Three Jamarāt

Ruling 581, Question: Is it permissible for a woman to perform the stoning (ramy) of the three Jamarāt at night due to fear of overcrowding during the day? If so, is it obligatory for her to stone only at night, or is it also permissible for her [to perform it herself during the day or] to appoint a proxy (nā’ib) to do it at this time?
Answer: If she is able to perform the stoning (ramy) at night—even on the night following the prescribed day—it is not valid for her to appoint a proxy (nā’ib).

Ruling 582, Question: If a Hajj pilgrim intends to perform both the make-up (qaḍā’) of the previous day’s stoning (ramy) and the stoning (rmay) due for that day (adā’) on the 11the or 12th day [of Dhul-Ḥijjah], considering that qaḍā’ must precede adā’, and if he does not observe the required precedence of qaḍā’ over adā’, is the adā’ of stoning (ramy) valid? In other words, is the precedence of qaḍā’ over adā’ an obligatory ruling, or is it a waḍʿī (declaratory/conventional) ruling?
Answer: If the required order between qaḍā’ and adā’ is not observed, the stoning (ramy) must be repeated correctly. This ruling is based on fatwā in cases of deliberate omission, and on the obligatory precaution (al-iḥtiyāṭ al-wājib) in cases of ignorance or forgetfulness.
