The Istiftā’āt (Juristic Inquiries) on the Stoning (Ramy) of the Jamarāt al-‘Aqabah

Ruling 505, Question: During or before performing the stoning (ramy) of the Jamarah al-‘Aqabah, a pebble that was previously used falls into my bag and mixes with unused pebbles. Is it sufficient to throw eight pebbles at the Jamarah, even if one of them might have been used before?
Answer: If certainty is achieved that the required number of pebbles was unused, the stoning ritual is valid.
Ruling 506, Question: If a Hajj pilgrim can perform the stoning (ramy) of the Jamarah al-‘Aqabah in the afternoon of ‘Īd al-Aḍḥā, when the Jamarah area is less crowded, is it permissible for him to appoint a proxy (nā’ib) to perform the stoning ritual in the morning so that he can perform the sacrifice on ‘Īd’s day? Is it, therefore, permissible for him to appoint a proxy to perform the stoning ritual in the morning so that he can perform the sacrifice on ‘Īd’s day, even though he is physically able to perform the stoning (ramy) in the afternoon? Additionally, what is the ruling for a Hajj pilgrim who, over several years, has had a proxy perform the stoning ritual on the morning of Īd al-Aḍḥā even though he can perform it himself in the afternoon?
Answer: If the Hajj pilgrim can perform the stoning (ramy) of the Jamarāt al-‘Aqabah at any time on ‘Īd’s day, even in the afternoon, appointing a proxy (nā’ib) is invalid. However, if he is certain he will remain unable to perform it and appoints a proxy, and later becomes able after the proxy has completed the stoning ritual, the proxy’s stoning is valid and does not need to be repeated. Regarding previous years, if the proxy was appointed without a valid excuse, the pilgrim must make up those stoning (ramy) rituals.
Ruling 507: With the recent expansion of the Jamarāt, if a part of the pillar of Jamarat al-ʿAqaba is located outside of Minā, assuming that the designation of jamara applies to the entire wall, is the stoning (ramy) of that part valid?
Answer: In the event of certainty that a part of the expanded jamara is outside of Minā, the recommended precaution (al-iḥtīyāṭ al-mustaḥab) is that he should stone a point on the part that is not outside of Minā.
Ruling 508, Question: [According to the ruling on the stoning ritual,] it is permissible for women to perform the stoning (ramy) of the Jamarāt al-‘Aqabah on ‘Īd al-Aḍḥā’s night (the 10th of Dhul-Ḥijjah). Is it necessary for the stoning to be done only on ‘Īd’s night, or may the women perform the stoning on the night of the 11th of Dhul-Ḥijjah? What is the ruling if a woman is performing Hajj on behalf of someone else?
Answer: If she is able, she must perform the stoning (ramy) of the the Jamarah al-‘Aqabah on ‘Īd al-Aḍḥā’s night (the 10th of Dhul-Ḥijjah), especially if she is performing Hajj on behalf of someone else. Delaying it until the night of the eleventh is not valid. She may also do the stoning on ‘Īd’s day.
Ruling 509, Question: If there is a life-threatening danger to a Hajj pilgrim in performing the stoning (ramy) of the Jamarāt al-‘Aqabah on ‘Īd al-Aḍḥā’s day, is it obligatory for him to observe the prescribed order of the rituals on that day, or may he disregard the order?
Answer: If the life-threatening danger persists throughout the entire day of ‘Īd, it is permissible for the pilgrim to disregard the order. However, the obligatory precaution (al-iḥtiyāṭ al-wājib) is that he should not delay sacrifice or shaving the head (ḥalq) after ‘Īd al-Aḍḥā.
