The Istiftā’āt (Juristic Inquiries) on the Mīqāts (Mawāqīt)

Ruling 155, Question: If a Hajj pilgrim, due to ignorance of the ruling, enters iḥrām in the city of Jeddah and performs the rites of ‘Umrah al-Mufradah, and later realizes that he should have gone to a mīqāt, is his ‘Umrah al-Mufradah valid?
Answer: He has no other obligation (taklīf). However, if he has acted as a proxy (nā’ib or if it has been an obligatory ‘Umrah for any reason, such as (nadhr), then his ‘Umrah does not suffice.
Ruling 156, Question: Does Ḥudaybiyyah hold the same ruling as the five designated mīqāts? Is entering iḥrām there valid?
Answer: Ḥudaybiyyah does not hold the same ruling as the five designated mīqāts, and entering iḥrām there for the rites of the ʿUmrah al-Tamattuʿ is considered invalid.
Ruling 157, Question: If a Hajj pilgrim in Makkah al-Mukarramah wishes to perform the ‘Umrah al-Tamattu‘ but is excused (ma‘dhur) from traveling to a mīqāt, is it sufficient for him to enter iḥrām from Adnā al-Ḥill (the nearest point outside the boundary of the Ḥaram)?
Answer: Entering iḥrām from Adnā al-Ḥill for the rites of the ‘Umrah al-Tamattu‘ suffices.
Ruling 158, Question: If a Hajj pilgrim resides at a distance of less than 16 Farsakhs (approximately 88 km) from Makkah al-Mukarramah, is he obligated to enter iḥrām from his place of residence, or is it permissible for him to do so from any location within his city?
Answer: He may enter iḥrām at any location within his city; however, the recommended precaution (al-iḥtīyāṭ al-mustaḥab) is that he should do so from his home.
Ruling 159, Question: Is it permissible for me, without a valid excuse (‘udhr), to make a vow (nadhr) to enter iḥrām before the mīqāt, knowing that after iḥrām I will have to go under the shade of something (for example, by boarding an airplane)?
Answer: The vow to enter iḥrām before a mīqāt is valid, and it is permissible to fulfil the vow by entering iḥrām. However, sheltering in a shaded place during the day and in the state of iḥrām is prohibited (ḥarām), and a ruling on an issue cannot be applied to a ruling on another.
Ruling 160, Question: If a Hajj pilgrim resides in Madīnah al-Munawwarah or its surrounding areas and wishes to perform the ‘Umrah, is it permissible for him to pass by al-Shajarah mosque without entering iḥrām, travel to Jeddah, and then enter iḥrām at Adnal-Ḥill (the nearest point outside the boundary of the Ḥaram), such as at al-Tanʿīm mosque?
Answer: If he leaves Madīnah al-Munawwarah with the intention (nīyyah) of performing the ‘Umrah, it is obligatory for him to enter iḥrām at al-Shajarah mosque, and it is not permissible for him to pass by the mosque without entering iḥrām, even if he plans to visit Jeddah before Makkah al-Mukarramah. However, if he leaves Madīnah al-Munawwarah with the intention of travelling to Jeddah, it is not obligatory for him to enter iḥrām at al-Shajarah mosque, and he may travel to Jeddah without entering iḥrām. In this case, if he later intends to perform the ‘Umrah while in Jeddah, he is obligated to travel to one of the five mīqāts to enter iḥrām, as entering iḥrām from Adnā al-Ḥill or Jeddah is not valid.
Ruling 161, Question: If a Hajj pilgrim tends to travel from Madīnah al-Munawwarah to Makkah al-Mukarramah, there are two routes available: one that passes near Juḥfah, where the parallel points (muḥādhāt) to the mīqāt has been established; the other is a highway that, although it also passes near Juḥfah, is over 100 kilometers farther and is not a direct course. Does this highway also count as a parallel point?
Answer: Muḥādhāt, or parallel points, are defined when a Hajj pilgrim arrives at a point where the mīqāt [such as Juḥfah] is situated to the right or left of his route to Makkah al-Mukarramah. Therefore, both routes mentioned equally meet the condition of parallel points or muḥādhāt, regardless of their distance or directness.
Ruling 162, Question: If a Hajj pilgrim fears for his own or his dependents’ safety from entering iḥrām at a mīqāt, is it permissible for him to pass the mīqāt without iḥrām and then enter iḥrām at the nearest point outside the Ḥaram?
Answer: It is permissible for him to pass the mīqāt without entering iḥrām. If his excuse (‘udhr) is removed after passing the mīqāt, he must return to the mīqāt and enter iḥrām. Otherwise, it is obligatory for him to enter iḥrām at the next mīqāt or another mīqāt ahead. If none of these locations are possible, he is obligated to enter iḥrām from the location where he is.
Ruling 163, Question: Is the courtyard, defined as the open area surrounding al-Shajarah mosque, considered as a part of the mosque for the purpose of entering iḥrām, or does the term "mosque" refer only to the area designated for prayer? And is it permissible for a menstruating woman (ḥāʾiḍ) to enter iḥrām in the courtyard, either to the right or left of the mosque? What is the ruling regarding entering iḥrām within the courtyard situated behind al-Shajarah mosque?
Answer: The designated mīqāt of al-Shajarah mosque is confined to the mosque building itself, even including the newly constructed parts, but does not apply to the open courtyard. It is not permissible for a woman with a religious (shar‘ī) excuse (‘udhr) to enter iḥrām in the courtyard of the mosque; she is obligated to (a) enter iḥrām while passing through the mosque (i.e., entering one door and exiting another), or (b) make a vow (nadhr) to enter iḥrām before arriving at this mosque, or (c) enter iḥrām at Juḥfah or its parallel points (muḥādhāt) if it is not possible for her to enter iḥrām inside the mosque, even while passing through.
