            15. Engaging in Disputing (Jidāl) (Swearing by the Name of Allah

             

            Ruling 283: It is impermissible (ḥarām) for a muḥrim (a Hajj pilgrim in the state of iḥrām) to engage in any disputing (jidāl) with others in a way that includes swearing by the sacred name “Allah,” such as saying “No, by Allah” or “Yes, by Allah” during an argument.
            Ruling 284: The obligatory caution (al-iḥtiyāṭ al-wājib) is that a muḥrim (a Hajj pilgrim in the state of iḥrām) should avoid swearing by names that are translations of “Allah” in different languages—such as “Khudā” in Farsi—as well as by other Divine names such as al-Raḥmān, al-Raḥīm, al-Qādir al-Muṭlaq, etc.
            Ruling 285:  Swearing by non-divine entities is not considered one of the prohibitions (muḥarramāt) of iḥrām.
            Ruling 286: There is no kaffārah (expiation; atonement) for swearing truthfully by Allah’s name, but it is obligatory to seek Allah’s forgiveness (istighfār) after the first and second oaths. However, for more than two truthful oaths taken, it is obligatory to offer a kaffārah of one sheep.
            Ruling 287: If a Hajj pilgrim in the state of iḥrām swears falsely, it is obligatory to offer a kaffārah of one sheep after the first and second oaths, although it is recommended precaution (al-iḥtiyāṭ al-mustaḥabb) to offer two sheep for both oaths as a kaffārah. However, if he swears falsely more than twice, it becomes obligatory to offer one cow as a kaffārah.
